A man was released from jail after his wife approached a city court for his early release. The man was convicted on March 21, Holi, for driving in an inebriated condition and sent to 10-day jail term.
However, moved by the woman's plea, where she requested the court to restore 'homely atmosphere' to her house, the sessions court set aside the decision of metropolitan magistrate.
It, however, upheld the fine imposed on the accused.
The metropolitan magistrate had jailed Anil Mahajan for 10 days and fined him Rs 2,000 under the Motor Vehicles Act and Rs 1,000 for driving an uninsured vehicle.
Mahajan was convicted on the Holi day, after traffic police caught him riding a scooter in Connaught Place under the influence of alcohol and without statutory vehicle insurance.
Additional sessions judge JR Aryan said: "Life in jail even for two or three days may have the same effect and impact, as it would have if the accused remained in jail for 10 days. He has already been imposed fines which is the maximum prescribed for the offence."
The judge also noted that in her plea, she submitted that her husband will not repeat the offence and asked for another opportunity to be given to her husband, by reducing the sentence of imprisonment to the period undergone.
The accused, who was in jail for more than two days, was ordered to be freed on March 23.
