Sanjay Bansal, Additional Chief Metropolitan Magistrate noted that Shilpi (30), who is a Master of Commerce, Master of Arts, a Bachelor of Education and also a teacher, despite having an excellent educational background, agreed to get into a marriage despite huge demands for dowry.
Laviral Kalra (32) (name changed) and Shilpi (name changed) got married on November 2, 2006.
Laviral works as a software engineer with HCL Technologies and resides with his parents at Indrapuram, Ghaziabad. The couple has a one-and-half-year-old son from their marriage.
On April 13, 2009, Shilpi lodged a case of domestic violence against her husband and in-laws, and an FIR was registered on December 12, 2009 at the Roop Nagar police station.
Gagan Preet Singh and Karan Bir Singh, counsels for Laviral said, “Both giving and taking dowry is a crime.
Shilpi becomes an accused as she got married after giving dowry.” The court noted that in a circular issued by the office of the Commissioner of Police,
Delhi, directions have been issued to lodge cases against the girl and her parents, if allegations regarding giving dowry are made, and if girl is “grown up and well-educated.”
Laviral’s father, who suffers from several diseases, said that Shilpi deserted her matrimonial house willingly, and simply refused to come back.
The court noted that Shilpi and her family are accomplices under the Dowry Prohibition Act.
The court has ordered Station House Officer (SHO), Roop Nagar police station to register an FIR against Shilpi and her parents and conduct investigations into the case.
