Ten years and intervention by HRD minister Kapil Sibal has not been enough for the HRD ministry to decide an appeal filed by a sacked lecturers to re-consider his dismissal from service.
SS Dubey was a lecturer at Indira Gandhi National Open University (IGNOU) till 2002, when his services were terminated on the ground of indiscipline. As Ignou did not have its own rules, it adopted the Central Conduct Service rule of 1965.
Under the rule, any official, whose services are terminated has a right to file an appeal with the President. Dubey filed an appeal in August 2002, which was referred to the HRD ministry to take a final call.
Nothing much happened for the next three years despite several reminders by Dubey. When the RTI Act came into force, Dubey filed an application seeking status of his appeal. To his disdain, the ministry claimed that his file was not traceable.
The appellate authority under the RTI Act in the ministry, NK Sinha directed the ministry to reconstruct the file and process the file to get comments of Ignou chancellor on his appeal. The university appointed a committee under the chairmanship of DK Choudhary to examine the case in light of the communication received from the ministry.
The Choudhary committee suggestion to review action Dubey was discussed in the Ignou board meeting and the ministry was informed.
Again in January 2010, Dubey made a representation to the ministry seeking decision on his appeal. He even met HRD ministry Kapil Sibal four times, who assured Dubey that a speaking order will be issued soon.
Not been able to decide on the appeal in almost 10 years, the ministry has now asked Dubey to knock the doors of the university, which sacked him, to get justice. I just want that the ministry should decide on my appeal on merit, he said, after running from pillar to post for almost a decade.
