The Central Bureau of Investigation (CBI), on Wednesday, chargesheeted Sajjan Kumar in two separate cases relating to 1984 anti-Sikh riots.
Kumar, a former Congress Member of Parliament (MP) from Outer Delhi, has been charged under section 302 and 153-A, implicating him in murder and promoting enmity between classes.
The agency filed the investigation report in the court of Chief Metropolitan Magistrate Kaveri Baweja.
Kumar is the main accused in two cases of rioting at Sultanpuri police station and Delhi Cantonment police station on November 1, 1984. Seven persons were murdered at Delhi Cant. and five at Sultanpuri.
A total of 11 witnesses recorded their statements before the magistrate.
A key witness, Nirpreet Kaur whose father Nirmal Singh, the president of Gurudwara association was burnt alive in the riots at Delhi Cant, recorded her statement in Amritsar.
Similarly, Jagdish Kaur deposed before a magistrate also in Amritsar. The other nine witnesses recorded their statements in Delhi.
“The then MP (Kumar) instigated a mob of about 300-400 persons to kill and burn the people of Sikh community ... and to loot and burn their houses,” the CBI said in court.
The other accused
At Delhi Cantonment, the CBI has chargesheeted seven people other than Sajjan Kumar.
They are Balwan Khokar
(local counselor from Congress in 1984), Mahender Yadav
(ex-MLA from the Congress), Kishan Lal Khokar, Saroj, captain Bagmal and Mahender Yadav.
In the FIR registered at Sultanpuri the CBI has chargesheeted five more people along with Kumar.
The CBI has also filed a closure report in a case registered with the Mongolpuri police station in which one person was killed.
According to the CBI, no witness is available in the case.
All the three cases were registered on the recommendation of Justice G.T. Nanavati Commission that had inquired into the sequence of events leading to the 1984 anti-Sikh riots in the aftermath of the assassination of the then Prime Minister Indira Gandhi.
H.S. Phoolka, senior advocate and counsel for the victims, said, “We will oppose Sajjan Kumar’s bail in the case.”
The CMM marked both the chargesheets as well as the closure report to the court of Additional Chief Metropolitan Magistrate Lokesh Kumar at Karkardooma Court here.
The probe report will come up for consideration on Monday at the Karkardooma court.
