Faced with imminent arrest in connection with the murder case of her teenaged daughter Aarushi and domestic help Hemraj, dentist Nupur Talwar has rushed to the Supreme Court seeking anticipatory bail.

Talwar is facing a non-bailable arrest warrant (NBW) issued by the Ghaziabad CBI Court after she failed to appear before it on Wednesday. A CBI team raided her house after that but she wasn’t there.

Seeking “empathy and justice” from the top court, the dental surgeon has also challenged the April 9 Allahabad high court directive, which puts its March 13 order of giving 30 days to Nupur to surrender before the trial court in abeyance.

In the wake of the April 9 order, Nupur was to appear before the trial court on Wednesday. On failing to appear before it, the trial court issued a warrant.

Claiming the surgeon was not a fugitive, senior counsel Mukul Rohatgi asked for immediate relief on Nupur’s appeal from a bench headed by justice AK Patnaik. The bench, however, declined to entertain the plea. It said the matter could only be heard on Friday.

Seeking bail, Nupur’s appeal said her arrest at this stage would cause “great ignominy, humiliation and disgrace” not only to her but to the entire family and the community of law-abiding citizens.

Nupur further stated that she was never named as an accused either by the UP Police or CBI at any stage of the investigation. She claimed as the CBI had already filed a closure report in the murder case, “no benefit would be caused to anyone if fresh investigation is carried out by the learned magistrate”.
