The Allahabad high court on Wednesday filed a review petition in the Supreme Court demanding that the unprecedented critical remarks made against it by the country's top court last month be expunged.
A division bench of the Supreme Court comprising justices Markandey Katju and Gyan Sudha Misra, had on November 26 slammed the Allahabad high court, saying "something is rotten" there.
A day later, angry high court judges in a full court meeting had passed a resolution authorising their chief justice to move the Supreme Court seeking removal of the adverse remarks, reported first by Hindustan Times.
In the review petition, the high court has said the remarks made by the Supreme Court are "general in nature", and there was no reason for the apex court to have made such remarks, while deciding a particular case.
Further, the high court has stated that in case the honourable judges of the Supreme Court had any objection to the appointment of any high court judge, then they could have raised the matter in "the grievance forum" which is available to them.
The Allahabad high court, the largest in the country, has also stated that "it was completely unnecessary on the part of hon'ble judges to have commented on the appointment of judges in the high court."
It has also pointed out that "the general comments made about the entire high court are not acceptable since these have caused a damage to the image of the judiciary and should be expunged from the November 26 judgement."
The issue has divided the high court with the judges and the lawyers taking opposite stands. The apex lawyers body, the high court bar association has welcomed the Supreme Court verdict and asked the chief justice to take steps to implement it.
In a strong indictment of the high court, the Supreme Court had stated: "Some judges have their kith and kin practising in the same court, and within a few years of starting practice, the sons or relations of the judge become multi-millionaires and have huge bank balances."
It had further stated: "We are sorry to say a lot of complaints are coming against certain judges of Allahabad high court relating to their integrity."
