Ban on app-based taxis to stay, govt tells HC

Standing by the decision to control and regulate all app-based taxi services plying in Delhi after the Uber rape incident, the government on Tuesday told the Delhi High Court that its blanket ban order on such taxis will continue and vehicles violating rules will be seized.

Justice Rajiv Shakdher was informed that both Uber and Ola cabs have been banned as per its January 1 order and vehicles found operating in contravention were being seized.

Following the alleged rape of a 25-year-old woman by an Uber cab driver, the transport department of the Delhi government had on December 8 banned the services of all app-based taxi services including Uber, Ola, Taxi for Sure, and TaxiPixi. It had asked them to get fresh licences from it in line with the Radio taxi Scheme, 2006.

Shortly after the order, US-based cab operating service Uber had challenged it in the HC, which in turn directed the city government to give a detailed hearing to Uber and other affected parties including Ola cabs.

The government told the HC that it had considered the representation made by Uber and Ola cabs and on January 1 came to the conclusion that, “there are no grounds to review the ban imposed.”After the government made the submission, Uber withdrew its plea against the December 8 ban from the HC. Uber also told the HC that it was the only company that was complying with the order, while Ola continued plying in Delhi.

In response, the Deputy Commissioner of Transport Department, who was present in court, submitted that they are taking action by seizing all vehicles which are operating despite the ban. It further said that since Uber operates diesel/petrol run vehicles, it is violating the Supreme Court direction that the All India Tourist Permit cabs in Delhi should run on CNG.

Meanwhile, Uber, in a statement said, “The petition was withdrawn with liberty to avail remedies as may be available under law. We continue to have faith in the judicial and executive system, trusting that the interests of Delhi’s riders, and livelihoods of our driver-partners would be central to any decision.”
