BMW case: Bhasin moves SC for bail

Utsav Bhasin, who knocked down two men on a motorcycle with his BMW last September, has moved the Supreme Court after Delhi High Court refused him bail.

The 19-year-old son of a Haryana industrialist has questioned Delhi Police’s move to book him under the stringent Section 304 (culpable homicide not amounting to murder) of the IPC, which prescribes life imprisonment as the maximum sentence. This section was added after Mrigank Singh, the surviving victim alleged Bhasin had dragged them on for several yards after hitting them. Anuj Singh had succumbed to his injuries. Mrigank and Anuj were knocked down near Moolchand flyover on September 11.

A bench headed by Justice SB Sinha has directed Delhi Police to file its response within two weeks.

Bhasin denied running away from the spot and claimed as a “responsible citizen” he had called the police. As he had no intention to kill the victims, the section was not applicable to him, he claimed in his appeal to the apex court.
