Court tells police to act on fake licence holders

It could mean the end of the road for those holding and issuing fake driving licence.

In an unprecedented initiative, the Delhi High Court has asked the Ministry of Road Transport and Highways and Police to consider their prosecution.

Dealing with a compensation claims case wherein a driver who was holding a fake driving license caused the accident, Justice J.R. Midha suggested stringent punishment for accused who run away from the spot after causing the accident and destroys evidence.

Crackdown must

The court issued notices to the Delhi Road Transport Authority and Delhi Commissioner of Police to explain what action was being taken to curb the issuance of fake driving licenses and those who indulge in it as “it is a serious criminal offence and a danger to the society”.

“It is noticed that in large number of cases the insurance companies upon investigation after the accident discover the driving license of the driver to be fake,” said Justice Midha. “The victims suffer because the insurance companies deny the liability on the ground of fake license. However, no action is taken by any authority against persons who hold or issue fake licence.”

The court said there was a need to frame strict law in this regard as it could reduce the number of accidents.

The court was told by the insurance companies that the police never make any serious effort to ascertain the genuinity of a license and in most cases it is revealed only after verification by the investigator appointed by insurance companies after an accident.

Curb Hit ‘n Runs

Noting that between 38 and 50 percent of accidents in the city were hit and runs, the court said this gave the driver precious time to destroy evidence.

The judge suggested severe punishment for the accused who run away from the spot.
