Delhi MLA jailed for breaking open MCD seals

The Supreme Court on Tuesday held Delhi legislator H.S. Balli guilty of contempt of court for breaking open several illegal commercial establishments in Rajauri Garden sealed by the municipal body under the apex court's directions, and sent him to jail for three- months.
A bench headed by Justice Arijit Pasayat sent Balli to Tihar jail after dismissing his claim that he, as a people's representative, was entitled to flout court directions.

The bench also ordered the Delhi police commissioner to personally appear in the court on Wednesday with an affidavit explaining his failure to provide sufficient forces to the Municipal Corporation of Delhi (MCD) to carry out the sealing operations.

Furious at the dilly-dallying approach of the police and municipal authorities in forcing the closure of commercial establishments not shielded by the Delhi Master Plan-2021, the apex court said: "It has become too much. It has become a fashion for everyone to think that the Supreme Court is the most unimportant organisation."

The court also asked the MCD commissioner to file an affidavit in the court explaining its failure to coordinate with the apex-court-appointed monitoring committee in carrying out the sealing drive.

Ordering the MCD to continue sealing the commercial establishments not protected by the Delhi Master Plan-2021, the court also asked the union government to describe its plans by May 7 as to how it would develop the city's infrastructure related to power, water, sewage disposal system, health and traffic to ensure that they cope with the city's proposed growth under the Delhi Master Plan-2021.
