The Delhi police on Wednesday refused to direct IGNOU to provide a copy of the BA first year examination schedule to Vinay Sharma, one of the accused in the December 16 gangrape case.

Special public prosecutor Dayan Krishnan, in his reply filed before special judge Yogesh Khanna, said the police cannot arrange any such details as the matter did not relate to it. Vinay is one of the four accused who is being tried for raping a 23-year-old girl on a moving bus in December 16 last year. He had moved an application before the court seeking the schedule of examination.

Vinay's counsel AP Singh had, in his plea before the judge, said his client had taken admission in first-year of BA programme of the Indira Gandhi National Open University (IGNOU) in August last year and now needed to appear in his examination.

Krishnan, however, told the court that the Station House Officer concerned cannot be directed to go to the university and collect the schedule as the matter is between the accused and the university.

"How can we go and collect the exam schedule," Krishnan asked, adding that the family members instead should go and collect the exam schedule. The court had yesterday asked the police to file its response to the plea filed by Vinay who had said the university was not giving out the schedule, making it "difficult" for him to prepare for his exams". The judge also down the request of counsel ML Sharma, appearing for another accused in the case Mukesh, seeking exemption from personal appearance on Thursday.
