The Supreme Court on Friday asked the Election Commission to decide on the maintainability of a complaint against putting up of Bahujan Samaj Party's election symbol 'elephant' in public places in Uttar Pradesh in violation of the commission's notification.

An apex court bench headed by Chief Justice of India SH Kapadia said the commission would place its decision before it. Thereafter, the court will examine the decision and, if required, more powers will be given to the commission for further action.

The commission has been given three months to decide on the complaint by petitioner Ravi Kant.
