The Delhi government’s transport department may request the Supreme Court to clarify its January order to issue no-objection certificates for diesel vehicles older than 10 years if the owners wanted to sell them outside Delhi-NCR.
The National Green Tribunal on Monday -- following on its April 2015 order banning diesel vehicles older than 10 years in the national Capital -- asked the transport department to deregister all such vehicles.
This created confusion on whether if fresh NOCs could be issued and the department intends to clarify the matter before the apex court.
“The deliberation is on how much more time we should give to owners of such vehicles. In the last six months, over 25,000 car owners have taken NOC from the department. We will request the SC to clarify so that we can continue giving NOCs. We will issue a deadline till when NOC can be taken,” said a senior transport official.
The transport department identified 2.82 lakh vehicles that are 10 years old. An analysis by the department showed Delhi had 1.6 lakh private and 1.2 lakh commercial diesel vehicles that are over 10 years old.
“After getting the clarification, the second step would be to start deregistering these vehicles. If we don’t get time to give NOCs, we will start cancelling registration of vehicles. A notice will be sent, saying the vehicle can no longer ply in Delhi. We have the addresses but sending notices to them will take time. We will share details with the traffic police so that whenever they stop a vehicle, they can check if it is over 10 years old. We will issue public notices urging people not to violate the rule,” the official added.
The government said it would ask the regional offices to send out notices and identify vehicles that are nearing the 10-year deadline so that advance notices can be issued to them.
The transport department decided not to transfer the registration number of vehicles beyond the prescribed age. Of eight lakh diesel vehicles in Delhi, 1.6 lakh private and 1.2 lakh commercial ones are more than 10 years old.
