HC verdict on nursery admission PIL today

The Delhi high court will on Tuesday deliver the much-awaited verdict on a public interest litigation (PIL) demanding scrapping of the nursery points system.

The judgment will come at a time when most city schools have already declared their first list of selected students. The PIL filed by NGO Social Jurist had termed the selection process being followed by private schools as against the Right to Education Act and discriminatory.

Seeking its dismissal, the Centre and Delhi government had submitted before the court that nursery admissions do not come under the purview of the RTE, which is only applicable to students aged from six to 14, while nursery admission starts at a younger age. The Centre had also said that the city government can have its own policies for such admissions.

If the government’s stand is upheld, it would mean 75% of seats in private schools meant for general category can be filled as per points-based criteria formulated by the schools and the ongoing admission process won’t be derailed.

Till the age factor was first brought to its attention on January 30, the court had come down heavily on the schools and the governments for the introduction of the points system in nursery admission.
