A prosecution witness produced by the Central Bureau of Investigation (CBI) in the court hearing the Aarushi-Hemraj murder case on Friday claimed that the Talwars’ servant was “indulging or was about to indulge in sexual activity” when his death took place.

The witness, Dr Naresh Raj — a senior paediatrician at the Noida district hospital — conducted the post-mortem of Hemraj on May 17, 2008.

Raj told CBI special public prosecutor RK Saini that Hemraj’s sexual organs showed signs of arousal, indicating “he had or was about to have sex when he died”.

Forty-five year old Hemraj was the domestic help of Rajesh Talwar and Nupur Talwar. His body was found on the terrace of the house on May 17, 2008, a day after Aarushi was found dead.

Giving details of injuries on his body, the doctor said the back of the victim’s elbows had scratch marks. Cut marks were found on the front of the neck and the sides.

There were deep injury marks on the back of his head. The back bone of the head was found fractured. When the chest was opened during post-mortem, both the heart chambers were found empty, he said.

Dr Raj said the marks on the elbow could be because he was dragged on a hard surface. The neck injury could have been caused by a sharp-edged item such as a surgical scalpel.

“Injury numbers 6 and 7 were probably caused by some hard item such as golf stick,” he said.

The witness’ examination concluded on Friday. His cross-examination by defence lawyers will be scheduled in the next hearing.

Talwars’ lawyer Manoj Shishodia said they will question the witness with the help of medical jurisprudence and findings mentioned in medical books.
