The CBI on Friday told a Delhi court that Unitech Wireless managing director Sanjay Chandra had a criminal background, saying he was facing cheating and forgery charges in a case in Noida.
Opposing the bail plea of Chandra in the 2G case, the SC-appointed CBI's special public prosecutor UU Lalit submitted a copy of a chargesheet and an FIR registered against Chandra to special Judge OP Saini.
“He (Chandra) has already been chargesheeted as an accused in a criminal case in a UP court. Therefore, this court should deny bail to him”, Lalit argued.
He also opposed the bail pleas of other corporate honchos - Swan Telecom MD Vinod Goenka and Reliance Telecom officials — Gautam Doshi, Surendra Pipara and Hari Nair.
After hearing arguments from the CBI and the accused, the court said it would pronounce its verdict on April 20.
Describing Chandra as an influential individual with a criminal background, Lalit said if released on bail, he could influence witnesses who have recorded their statements against him in the case. Many of the witnesses in the case earlier worked under his supervision, Lalit added. The agency has already told the court that its witnesses faced threat.
Referring to the role of Unitech in the scam, the CBI said Unitech group companies were in business of real estate and therefore, ineligible to apply for 2G spectrum licences.
Senior advocate KTS Tulsi for Unitech said the CBI counsel was going beyond the scope of bail arguments. "The accused should be granted bail, as the agency never required HIS arrest while probing the conspiracy in the scam," Tulsi told the court.
Opposing the bail plea of the five accused, Lalit said they might "abscond" and obstruct the course of justice.
Some of the key witnesses, belonging to the corporate world, directly worked under them and the possibility of the accused winning them over could not be ruled out.
"The accused in this scam have caused immense damage to financial health of the country", he said.
Appearing for Goenka, senior advocate Mukul Rohatgi said: "The accused is entitled to be released on bail. The chargesheet has already been filed and cognisance taken. If an accused is not arrested during the investigation, then there is no question of his arrest subsequently".
