A Delhi court on Monday granted bail to a couple arrested for allegedly kidnapping a two-year-old daughter of a businessman from India Gate.
"Both the applicants (the couple) are ordered to be released on bail on their furnishing personal bonds in the sum of Rs 10,000 each with one surety of like amount," Additional Sessions Judge S P Garg said.
The court allowed the plea of Ashok Bansal, advocate appearing for accused Rekha and Jugal Kishore, that the kidnapped child has already been recovered and moreover, the couple had no criminal background.
"She (the victim) was not recovered from the custody of any of the accused. No harm whatsoever was caused to the child by the accused after her alleged kidnapping," the court said, adding that the penal provision relating to kidnapping was not "prima facie" applicable against them.
Earlier, a magisterial court had dismissed their bail applications, saying the probe in the case was in an initial stage and their plea was devoid of any merit.
The couple, hailing from Raghubir Nagar in New Delhi, were remanded to judicial custody till July eight following their arrest in the kidnapping of Yashasvi alias Ghungun who had gone missing on June 18 while playing at the lawns of India Gate where her parents had gone for an outing.
The girl, whose father Vijay Kumar is a businessman in Dilshad Garden in New Delhi, was found at a temple 40 hours later. Police suspected that the couple let her off as they were frightened by the media attention to the case.
