No bail to Utsav Sharma, to stay on at Dasna Jail
A Ghaziabad chief judicial magistrate (CJM) court rejected the bail application of Utsav Sharma, who is presently under judicial custody and facing attempt-to-murder charges for an assault on Dr Rajesh Talwar inside the court premises on January 25.
A Ghaziabad chief judicial magistrate (CJM) court rejected the bail application of Utsav Sharma, who is presently under judicial custody and facing attempt-to-murder charges for an assault on Dr Rajesh Talwar inside the court premises on January 25.
The court order stated that the assault was of a serious nature and the accused could not get bail. Sharma's lawyer SP Chaudhary said that Sharma's parents would now move the sessions court for his bail and for other applications.
On Tuesday, CJM DD Ojha himself questioned Sharma during court proceedings. Sharma was stated to be suffering from 'bipolar disorder'. His parents had filed an application with the CJM and asked Sharma to be shifted to a psychiatric facility at Agra or Delhi.
After questioning Sharma, the court observed that Sharma seemed to be of a sound mental-health at present and does not require shifting out of Dasna prison, where he is lodged.
In the same context, the court directed Dasna prison officials to keep Sharma under observation inside the prison hospital and also to obtain the opinion of Sharma's doctor and other medical experts, with the court's prior permission, about his mental condition.
Sharma is stated to be undergoing treatment from Dr Ratna Bilwani at Ahmedabad for the bipolar disorder. The court, on the basis of Sharma's medical reports, said that he was showing signs of improvement since August 2010.
Sharma, who studied at the prestigious National Institute of Design at Ahmedabad, had previously attacked former Haryana DPG SPS Rathore in a similar manner in Chandigarh.
CONFUSION OVER BAIL
There was confusion during Utsav Sharma's bail-hearing at the Ghaziabad CJM's court on Tuesday when a private lawyer appeared in his individual capacity during the hearing and opposed Sharma's bail from the prosecution side.
After the January 25 assault on Dr Rajesh Talwar and Utsav Sharma's arrest by the UP police, his elder brother Dr Dinesh Talwar had lodged an FIR in the case at the Kavi Nagar police station.
Speaking to HT, Dr Dinesh Talwar said that the Talwar family had not deputed or hired any private lawyer for Tuesday's hearings in Sharma's case nor did they authorize anyone to appear on their behalf.
Talwar's lawyers Satish Tamta and Praveen Rai, also clarified that their clients had not hired a lawyer.
