The National Consumer Commission asked a packers-and-movers company to pay a woman a compensation of Rs 50,000 for damaging her household items while transporting them from Bangalore to Gurgaon five years ago.
According to her petition, Renu Sharma, a resident of DLF Gurgaon, hired Aggarwal Packers and Movers to pack her household goods in Bangalore, transport to her new house and unpack them there.
However, Sharma found several articles to be badly damaged and some of them missing as well. She then approached the consumer commission, because the company declined to compensate her for the loss.
"Taking overall view of the case and the grievance, we deem that in the interest of natural justice, the respondent (the company) is directed to pay to Rs 50,000, as a lump sum amount, including compensation for loss and for mental agony, harassment, as well as the cost of litigation," a bench comprising of members VB Gupta and Suresh Chandra said while upholding the order of state consumer commission.
Sharma filed a complaint with district consumer forum, which awarded her Rs 20,000 in response to her claim of loss of Rs 1,35,800 for 17 items such as a microwave oven, wrist watches, crockery cabinet, computer hard drive, clothes, suitcases and many more.
Dissatisfied, she filed a review in state commission, which enhanced the compensation.
Aggrieved by the order, Aggarwal Packers and Movers filed a review petition in National Commission challenging the amount of compensation awarded by the state commission.
The company objected to the jurisdiction of the commission, because Sharma was a resident of Gurgaon.
The company denied any deficiency in service on its part and prayed for dismissal of the complaint.
