Elections in mind, the government has given the go-ahead for the sale and purchase of property in 312 former unauthorised colonies built on private land, but implementing the decision will be a difficult task.
A major hurdle property owners will face is establishing their ownership rights.Some of these 312 colonies are east Delhi’s Pandav Nagar E and F block, Sangam Vihar B 1 block, Gaffar Manzil Extension in Jamia Nagar, Gautam Nagar Hill Block in Gautam Nagar, Subhash Park Extension and Vikas Vihar in Uttam Nagar, Prem Nagar in Najafgarh. 895 such colonies were regularised last year.The urban development department had allowed sale and purchase of properties built on private land on March 12.The revenue department, which registers properties, was asked to look at the procedural aspects before giving the final go-ahead. Divisional commissioner Dharam Pal on Friday finally issued orders, directing all sub-registrars to allow sale and purchase in the 312 colonies, provided they meet the conditions.
“One of the major criteria they will have to fulfil is establishing their ownership rights. As most people registered their properties through general power of attorney (GPA), it is difficult to find the original owner. The sub-registrars have been told not to allow sale and purchase if the ownership trail is not legally established,” said a senior Delhi government official.
Another problem is most houses in these colonies are builder flats built on a single plot with multiple owners.
Presently, there is no policy under which such people can get their individual flats regularised.
“Those who can clearly establish their ownership can easily apply for regularisation but in case of multiple owners, where every person owns particular floors, a new policy will have to be framed by the civic agencies and the Delhi Development Authority (DDA),” said a senior official.
Sources said there was a lot of political pressure to allow sale and purchase before the Delhi assembly elections, which will be held later this year.Once registration of sale deed is allowed, these colonies are likely to witness a huge jump in property prices.
