Rapist told to pay Rs 3 lakh to fund minor victim’s education

A seven-year-old girl raped by her uncle will receive Rs 3 lakh to fund her education, a Delhi court has ruled while convicting the rapist under the stringent child rape laws.

Convicting Akshay, a middle-aged man, of raping his niece (his sister-in-law’s daughter) in August last year, the sessions court sentenced him to 10 years in prison and fined him Rs 1 lakh in a November 30 order.

It also directed the Delhi Legal Services Authority to pay compensation of Rs 2 lakh to the child and, in a first, specified the money should be used for the girl’s “educational expenses as well as other expenses”.

“Considering the young age of the prosecutrix, the mental trauma that she would have undergone and that she needs financial support to continue her studies, court recommends a compensation of Rs 2 lakh,” additional sessions judge Rakesh Pandit said and directed the victim’s family to approach Delhi Legal Services Authority for disbursement of the amount.

According to the prosecution, on August 17 last year, the girl told police that while she was sleeping on the roof of her house between the accused and his wife she felt sudden pain and upon waking up found that he had penetrated her private parts with his fingers.

The child’s mother and aunt called the police and Akshay was arrested. However, during the trial, the mother and aunt both turned hostile witnesses and tried to explain away the incident by saying Akshay had kicked the girl on the head because of which she had started crying.

However, the court remained convinced by the child’s testimony, saying it was “absolutely trustworthy and does not suffer from any embellishments”.

The judge noted that it was “unfortunate that the mother of the prosecutrix who had come to the police station and was aware of the assault that her daughter had suffered had failed to corroborate the testimony of the prosecutrix and joined hands with her real sister to protect the accused.”
