Rein in your men, Delhi HC to BSF chief

In a first of its kind order, the Delhi high court on Thursday ordered the director general of the Border Security Force to ensure that all kinds of "propriety" are maintained within its camps across the nation.

By "propriety", the court meant that no force personnel shall indulge in any negative engagement with the wife of other force personnel.

A bench of justice Pradeep Nandrajog and justice Sunil Gaur warned that, in such a case, since all the BSF personnel are armed, they may "take law in their hands" and the "consequences could be disastrous".

The remarks were made while the court upheld the conviction of one V Sebastian, BSF personnel.

He had moved the court challenging the punishment of three years rigorous imprisonment in 'force custody' and forfeiture of 10 years service regarding promotion and pension.

His commandant had pronounced him guilty of trying to molest the wife of a senior BSF official at a cantonment in Meghalaya.

Sebastian had gone to their flat to repair their heater.

He was convicted of trying to outrage the modesty of a woman.

The judges said: "In BSF camps it becomes extremely important that propriety is maintained and no personnel indulges in misadventure with the wife of another personnel... we find the penalty not to be disproportionate for the reason BSF personnel are armed and if such kind of incidents are condoned it may compel the angry husbands to take law in their hands. Needless to state, consequences would be disastrous".

The court also rejected Sebastian's argument that he would never have attempted the act in the presence of the three-year-old son of the "victim".
