A Delhi court has issued summons to a woman for aborting her pregnancy without the consent of her husband. Metropolitan Magistrate Rajinder Singh said there is "sufficient material" on record to summon the woman under the criminal act sections. The court has sought her appearance in the court on the next date of hearing.
One Laviral (name changed), an NRI from United States, filed a complaint in the court stating his wife Sunita (name changed) had aborted their first child against his wish. He alleged that his wife, in connivance with her parents, have hatched a conspiracy to harass his family.
Laviral's counsel Mahesh Tiwari told the court, "The woman had aborted the child, as he failed to fulfil her demands for a separate house in Faridabad, her native place. She had even threatened her in-laws and refused to reconcile."
Laviral's father, a senior citizen, had come to the court, as the former was occupied professionally in America.
His father narrated the story of his son's ordeal, which allegedly began few months after his wedding. He told the court that his son had got a protection order from a US court, which provides him immunity from his wife's cruelty. Tiwari told the court that Sunita along with her parents intentionally “opted for miscarriage” and led to criminal breach of trust of her husband and his family.
The court has fixed June 6 as the next date of hearing.
