Terms & Conditions:

1. The contest is open for Indian residents only. Participation in the Contest is purely voluntary.

2. The contest will start on 3rd March, 2008 and end on 8th March, 2008.

3. Winners will be selected on the Delhi, Mumbai, Bangalore stations on each of the contest days on the basis of answers to questions pertaining to What Women Want. The Fever 104 FM team has conducted an in-house survey to arrive at these answers and their decision in this regard will be final and binding Fever 104 programming team will be final and binding.

4. Employees of HT Music and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in this contest.

5. At the time of participation the participant/contestant must be at least 18 years of age. Production of Government accredited date of birth proof and PAN Number is mandatory to claim the prize.

6. No entry fee is payable for participation except prevailing call rates.

7. HTME does not take any responsibility for any errors arising out of incorrect or incomplete contest entry. HTME will not be responsible in any way for failure of any backend technology and/or the resultant inability of a listener to send in his/her entry. Only those call/messages which are received by HTME shall be considered for the registration/contest participation and HTME shall not be responsible for non-receipt of any entry.

8. HTME reserves the right to change the timing/dates/hours of the Contest without any prior intimation to the participants/listeners. Moreover, the draw of lots for the prize(s) shall be organized at such designated centers and/or in such manner as may be decided by HTME from time to time.

9. Decision of HTME with respect to selection of winners shall be final and binding upon the participants/winners.

10. Only the winners shall be informed by HTME in such manner as may be decided by HTME from time to time. Prize must be collected in person from the office of HTME at each of the stations or any other place as instructed by HTME within 15 days of intimation, failing which HT Music reserves the right to deal with the prizes in such manner as it may deem fit. In order to claim the prize the winner must produce his Government of India issued photo identification proof of a PAN Card and a valid Indian Passport issued by the Government of India. All costs and expenses for collection of prizes shall be borne by winners.

11. If the Winner is a minor, then he/she must be accompanied by a parent/guardian for collecting the Prize. Both the winner and the parent/guardian must sign the terms & Conditions and produce their respective photo identification proofs to the satisfaction of HTME to claim the prize. In case false/fake identification details are submitted, the concerned participant/winner shall be disqualified.

12. If instructed by HTME prize must be claimed in person on production of any document evidencing the use / ownership of the mobile number used to vote/participate for the contest.

13. Though HTME shall make every effort to declare the results of the contest on the due date/hour for the respective prize draws, it shall not be responsible for any delay in announcing winners of the respective prize draws arising out of reasons beyond its control.

14. Prizes shall not be substituted for cash or for other prizes at any stage of the Contest. The Prize shall not be transferable and no such requests shall be entertained by HTME at any point.

15. All the costs and expenses, for collecting the Prize will be borne solely by the winner and HTME shall not entertain any claim, whatsoever in this regard. The winner is solely responsible for all expenses/taxes/documentations/passport/visa arrangements related to the acceptance and use of the offer.

16. In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize or if HTME is unable to reach/contact the winner at his mobile number from which entries were sent for the contest HTME shall have the absolute discretion to deal with such prize as it deems fit.

17. HTME shall not be responsible for any defects/inadequacy/deficiency in the prizes HTME would not be liable to replace/exchange the prizes at any stage of the offer. All complains/issues/mishaps related to the prize(s)/products should be referred directly to the respective manufacturer.

18. Where a specified prize becomes unavailable, HTME, in its absolute discretion reserves the right to substitute the same with any other prize of the same value.

19. All entries will be treated as the property of HTME and can be used by HTME for any promotional and/or commercial activity & the participants/winners waive all rights of whatsoever nature in the said entries in favor of HTME by participating in the contest.

20. Participants/winners may be required by HTME to participate in a photo, video and/or film session and acknowledge that HTME has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit without any consideration or payment of similar nature to such participants/winners.

21. HTME in its absolute discretion may publicize, broadcast or otherwise disclose a participant's/winner's name, particulars, likeness, statements or any recording of their voice in advertising or promotional activities concerning this contest, or generally. HTME may promote or advertise that a winner has won the contest.

22. HTME shall not be responsible for any loss or damage suffered by the winner while participating in the Contest.

23. This offer cannot be clubbed with any other offer.

24. HTME in its absolute discretion reserves the right to add, alter, modify, change or vary all or any of these Terms & Conditions, wholly or in part, at anytime without giving any prior notice and the participant/winner agrees to abide by such additions, alterations, modifications and changes.

25. HTME reserves the right to extend or to cancel, or change the manner in which the contest is organized or discontinue or terminate the contest at any time or to accept or reject any or all entries at their absolute discretion without giving any prior notice and without assigning any reason whatsoever.

26. Failure by HTME to enforce any of these Terms & Conditions in any instance(s) shall not give rise to any claim by any person.

27. Any attempt by a participant to deliberately damage or undermine the legitimate operation of the activity is a violation of Criminal and Civil Laws and should such an attempt be made, HTME reserves the right to seek damages from any such Candidate to the fullest extent permitted by law.

28. The Contest shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Contest and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by HTME. The venue of arbitration shall be New Delhi and the proceedings of such arbitration shall be in English Language only.

29. All disputes shall be subject to the exclusive jurisdiction of New Delhi Courts only.

30. Participation in the contest implies acceptance of all the terms & conditions herein.

These Terms & Conditions (hereinafter referred to as the "General Terms & Conditions") are applicable to all the participants/contestants of any contests (hereinafter referred to as the "Contest") promoted / organized by M/s HT Music & Entertainment Company Limited (hereinafter referred to as HT Music). The Rules can be amended or varied from time to time by HT Music.

1. Prize money/winning amount must be collected in person from the office of HT Music or from such other place as instructed by HT Music within 15 days of intimation, failing which HT Music reserves the right to deal with the prizes in such manner as it may deem fit. In order to claim the winning amount a person must produce his Government of India issued proof of identification or credit card/ College/ Institute/ School issued proof of identity along with proof of ownership of winning cell phone number. HT Music will not notify winners of the time remaining. On request of the Winner, HT Music may opts to post a prize money/wining amount to the winner, in such case HT Music shall have no responsibility for the safe and effective postal delivery of the prize money/wining amount.

2. If at any time HT Music discovers that the identification details, if so required, submitted by any contestant/participant/winner are false/fake, then HT Music can disqualified that contestant/participant/winner immediately from the contest.

3. If the prizes are in cash, HT Music will be deducting Taxes at source on the Prize amount, therefore, the person claiming the Prize money/wining amount must furnish his PAN number while claiming the Prize money/wining amount and in absence of PAN number, HT Music will not issue any TDS certificate to the winner.

4. In the event of any winner choosing not to accept a prize(s) or forfeit any and/or all claims qua the prize(s), HT Music shall have the absolute discretion deal with such prize(s) as it deems fit.

5. HT Music will not be responsible in any way for failure of any backend technology of SMS or IVRS applications and resultant inability of a listener to send in his/her entry.

6. Unless otherwise specified, participant must be at least 16 years or more of age on the date of entering / participating in the contest. Government accredited, Date of Birth proof is mandatory to claim the prize, in case of winning the contest.

7. Winners, if minor, must be accompanied by a parent/guardian for collecting their prize(s). Both the winner and the parent/guardian must sign this agreement and show their respective identification, which includes a photograph.

8. All costs and expenses for collecting the prize(s) will be borne solely by the winner and HT Music shall not entertain any claim, whatsoever.

9. If the prizes are other than cash :-

a) The prize(s) shall not be transferable / redeemable for cash and no such request shall be entertained by HT Music. And no substitution of prizes is possible and the winner will be entitled to only what has been declared through the random draw, if applicable.

b) All prizes are accepted entirely at the risk of the winner, and HT Music excludes all warranties in connection with any prize. HT Music, its agencies, affiliates; sponsors and representatives are not responsible for defective prizes or misuse of any prize, or for any claims, liability, loss or damage arising out of or in connection with any contest promoted/ organized by HT Music. All issues/mishaps related to prize products should be referred directly to the respective product companies.

c) Where a specified prize becomes unavailable, HT Music, in its absolute discretion reserves the right to substitute the said prize with any other prize.

10. Any one contest cannot be clubbed with any other offer/contest being run by HT Music.

11. Contestants/Participants shall indemnify HT Music against, all liability, cost, loss or expense arising out of acceptance of any prize(s) or participation in any contest including, but not limited to, personal injury and damage to property, whether direct or consequential, foreseeable, due to some negligent act or omission or otherwise, whatsoever.

12. HT Music, in its absolute discretion may publicize, broadcast or otherwise disclose a participant's/ contestant's/winner's name, character, likeness, statements or any recording of their voice in advertising or promotional activities concerning a specific contest, or HT Music contests generally. HT Music may promote or advertise that a winner has won a contest.

13. Participant's/contestant's/winner's may be required by HT Music to participate in a photo, video and/or film session and acknowledge that HT Music has the absolute and exclusive right to use such publicity photos, videos and/or films in any medium and in any reasonable manner it may deem fit.

14. Any and all government levies/taxes, including proposed future taxes, if any, arising on the prize(s) shall be borne solely by the winner(s). HT Music may insist on proof of payment of taxes before releasing the prize(s) to the winners or deduct the taxes at source.

15. All decisions by HT Music regarding the selection of the winners shall be final and binding.

16. Employees of HT Music and its affiliates/subsidiaries, sponsors of the prizes, associated agencies, participating operators and their immediate family members and relatives are not eligible to participate in any of the contests run by HT Music.

17. Participation in the contest implies acceptance of all the General terms & conditions and Special Terms & Conditions associated with the contest.

18. Failure by HT Music to enforce any of these Rules in any instance(s) shall not give rise to any claim by any person.

19. All the contests/Schemes shall be governed by and construed in accordance with the laws of India. Any disputes, differences and, or, any other matters in relation to and arising out of the Scheme and, or, pertaining to the rules and regulations and, or, the Terms and Conditions shall be referred to arbitration under the Arbitration & Conciliation Act, 1996. The arbitral tribunal shall consist of a sole arbitrator to be appointed by HT Music. The venue of arbitration shall be New Delhi.

20. All disputes shall be subject exclusively to Delhi jurisdiction only.

21. HT Music, in its absolute discretion reserves the right at anytime, without giving any previous notice to the participants, to add, alter, modify, change or vary all or any of these General terms & conditions, wholly or in part, or to withdraw the contest.
