HC order on regularisation creates panic in Ardee City

More than 500 flats in Ardee City face partial demolition following an order of the Punjab and Haryana High Court. The gated society has about 1,500 flats constructed 10 years ago by a private developer. In about 500 units, the builder constructed extra rooms, floors and balcony in gross violation of the building plan and sold the same to innocent buyers.

Later, the department of town and country planning (DTP) refused to give occupation certificates to 500 flat buyers, citing violation of construction norms. Now, the high court has directed the DTP to allow occupation to buyers after rectifying the violation of construction norms. The court has asked the DTP to remove only minor portions so that the building structure is not affected.

But, the residents fear that razing unauthorized portions may damage other flats. “If a single portion is to be removed on the ground floor, other floors may get damaged. The rectification order has scared all families,” said TN Kaul, president of Ardee City RWA.

The high court also asked the DTP to blacklist the builder, register a criminal case, and initiate action against the errant DTP officials under whose nose the violation took place.

In 2010, Ardee City RWA had moved the court against a DTP public notice, citing order of disconnecting sewer, water and electricity supply for violating building bylaws. “We convinced the court that builders violated laws in connivance with DTP officials,” said Susheel Khanna, a resident.
