Nick Leob has filed a lawsuit against actor ex-girlfriend Sofia Vergara, saying she is trying to destroy two cryopreserved female embryos created through in vitro fertilisation (IVF).
It is stated in the lawsuit that Loeb, 39, wanted to preserve the embryos while Vergara, 42, did not agree to it, reported Aceshowbiz. Vergara is now engaged to actor Joe Manganiello and planning her marriage.
The former couple reportedly had in vitro fertilisation which produced embryos from Loeb's sperm and Vergara's eggs. They used a surrogate to implant the embryo but they split before the embryo was successfully implanted in her.
The document in which Loeb is referred to as John Doe, and Vergara as Jane Doe states, "John seeks to save from destruction two cryopreserved Female Embryos created using John's sperm and Jane's ova for the purposes of attempting to have children. However, before the Female Embryos could be implanted in a surrogate, the Parties ended their relationship."
The document, which had been originally filed in August 2014, was refiled after amendment on April 1, 2015.
An insider said Loeb's feelings on the preservation of the fertilised eggs were tied to his political beliefs, "He has been a Republican his entire life and has always believed that life begins at conception. Nick is very emotionally invested in these female embryos because he's pro-life."
The document claims that Vergara was "physically and mentally abusive." It is written in the document, "She punched him in the face on two occasions, kicked him, and threw her phone at his head. She also routinely bullied him, calling him a 'loser,' 'worthless' and other degrading names."
