A 75-year-old man, who was accused of kidnapping and molesting a teenage girl after taking her to his house, has been sentenced to a month's jail term, the period already spent by him behind bars.
The court held Shrawan Kumar, resident of North East Delhi, guilty of the offences of kidnapping, outraging the modesty of a woman, criminal intimidation and wrongful confinement and imposed a fine of Rs 200 on him.
"After considering the fact and circumstances of the case, considering the age of convict...being senior citizen and he has remained in judicial custody for one month and four days and having responsibility of his family, this court comes to the conclusion that the ends of justice will meet if convict Shrawan Kumar is sentenced to a period already undergone for offences under sections 363/ 342/ 354/ 506 of the IPC and fine of Rs 200," Additional Sessions Judge Ramesh Kumar-II said.
According to the prosecution, the incident took place on the evening of April 13, 2011 when the 14-year-old girl had gone to a shop near her house.
The man had called her and dragged her in his home, after which he had bolted the door and molested her, police said, adding that he had beaten her when she had tried to raise an alarm and threatened her not to disclose the incident to anyone.
Some children had later informed the victim's mother that the girl was locked in a room and crying. The woman rushed towards the man's house and knocked the
door and after sometime when the door was opened, she saw the victim was nervous and had injuries on her head.
The man, who was hiding in the room, was beaten by the woman and other neighbours. Kumar was arrested by policemen of Nand Nagri police station here.
The man claimed that he was falsely implicated in the case and later sought leniency on the ground that he has to look after his family. While convicting Kumar, the court said all the prosecution witnesses have supported the case of prosecution.
