The Shillong Bench of Gauhati High Court has asked Assam Rifles to release arrested rifleman Hyder Ali.
Last year, Ali and 1,900 personnel of Assam Rifles had signed a petition and sent it to Union Home Minister Shivraj Patil urging better pay and parity for army personnel.
The rifleman was arrested on January 16 under the Army Act for carrying out an ‘improper’ campaign and court martialled.
Ali’s wife, Sahrar Bano, filed a petition against the Assam Rifles with the National Human Rights Commission (NHRC) for ‘illegally detaining’ her husband for the last nine months.
On September 6, Bano moved the Shillong Bench of the HC with a writ petition. She told the court her husband was being detained ‘illegally’ and sought the High Court’s intervention. His lawyer, Raghabendra Jha said that on October 12 the Shillong Bench of the Gauhati High Court had ordered Assam Rifles to release Ali from their custody.
