Ex-Karna HC CJ saw narco CDs in Abhaya case: CBI

The CBI on Monday informed the Kerala High Court that a former Karnataka HC chief justice and presently a Supreme Court judge had viewed the three CDs containing the narco tests conducted on the accused in the sister Abhaya murder case.

The oral submission, without revealing the name of the judge, was made by CBI Special Prosecutor S Sreekumar, on the basis of a statement made by former assistant director of Banglore-based Forensic Science Laboratory, Dr S Malini, to the investigating agency.

The Central agency's submission was made before a Division Bench during the hearing of a contempt petition filed by Abhaya's father, M Thomas, stating that CBI DYSP Nandakumaran Nair and Malini had committed contempt of court by not producing the original CDs of the narco test.

The CBI submission comes against the backdrop of the High Court's earlier observation that the CDs produced before the Chief Judicial Magistrate court by the agency had been tampered with and its direction to produce the original CDs. Abhaya's father had also stated that the CDs were not original and filed the contempt petition.

Sreekumar said there was no contempt. 'We have seized the original CDs and produced them. Since the Chief judicial magistrate was not satisfied, the CBI recorded the statements of Malini on June 30 and July 3 this year.
