A Delhi court on Friday granted bail to Liyaqat Shah, who was arrested two months ago on the suspicion that he was a Hizbul Mujahideen militant planning attacks in the Capital.

Benefiting from lack of evidence, Shah is the first accused to get bail in a case being probed by the National Investigation Agency. But district judge IS Mehta said he cannot leave India without the court’s permission.

A Delhi Police special cell had arrested Shah on March 20 while he was crossing the Indo-Nepal border in Gorakhpur. It had claimed to have foiled an attack ahead of Holi, while the Jammu and Kashmir police insisted he had come to India to surrender under the state’s rehabilitation policy. Chief minister Omar Abdullah had also expressed reservations about the allegation that Shah was a militant.
