Child-rights body requests police reports on south Delhi school sexual harassment case

The Delhi Commission for Protection of Child Rights (DCPCR) has asked the Delhi Police and the directorate of education to submit reports on the alleged case of sexual harassment that was reported from a prominent south Delhi school earlier this week.

The commission has given both the agencies 10 to 15 days to prepare and submit their reports.

Arun Mathur, DCPCR chairperson, said they would not be setting up a committee of their own as an FIR had been lodged in the case and the police had launched an investigation in the matter.

 “We have given both the agencies time to submit reports on the matter so that the investigations can reach a conclusion. There are clear guidelines about the rules and regulations to follow in such cases. The Protection of Children from Sexual Offences Act clearly mentions that if a teacher assaults a student, the offence will be considered as an aggravated assault,” Mathur said.

The DCPCR had come out with guidelines for prevention of child abuse earlier this year. The guidelines were released after consultation with the National Law School, Bangalore, and were to be distributed to every school.

The guidelines talk about the recruitment policy of schools and running background checks on teachers before they are hired. It also makes it mandatory for selected candidates to sign an affidavit stating that they have not been accused of offences under the Protection of Children from Sexual Offences Act, the Juvenile Justice Act or in other sexual/ violent crimes in the past.

On Monday, a teacher of a prominent south Delhi school was arrested on charges of molesting a class five student inside a classroom.

According to the police, the accused was identified as Nirmal Tamang, 35, who teaches in classes 5th to 11th and is a resident of Kailash Colony area. Since his arrest, four more students have approached the authorities, claiming that the teacher had molested them in the past 6-7 months.

Police sources said the accused teacher had locked himself inside a classroom with the girl and touched her inappropriately after school hours. He was spotted by the girl’s friends who informed her parents.
