Delhi court charges Kanda with rape, unnatural sex

Airhostess Geetika Sharma’s suicide case took a new twist on Friday with a Delhi court on its own charging main accused and former Haryana home minister Gopal Kanda with rape and unnatural sex.

District judge SK Sarvaria also allowed Kanda to be tried for abetting the suicide of the 23-year-old former airhostess besides criminal conspiracy and forgery under the Indian Penal Code and Information Technology Act for allegedly hacking into Sharma’s computer and sending offensive messages.

The police had not booked Kanda for sexual offences.

The court also framed charges of abetting rape and suicide against Kanda’s aide Aruna Chadha.

Sharma was found dead in her Ashok Vihar house on August 4 last year. In her suicide note, she had accused Kanda and Chadha of harassing and forcing her to take the extreme step. Six months later her mother too had committed suicide due to depression over her case.

After framing the charges, the district judge sent the matter for trial before the fast track court dealing with sexual offence cases. The court has fixed the matter for May 27 for recording of prosecution evidence.

“Further, prima facie charges under sections 376 (rape) and 377 (unnatural sex) are made out against Kanda and charge under section 376 read with 109 (abetment to rape) is made out against Chadha,” the court said.

During the arguments on framing of charges, public prosecutor Rajiv Mohan had said the suicide notes of Geetika and that of her mother, who ended her life on February 15, should be considered as concrete evidence against the accused.

Sharma’s mother Anuradha had also left behind two notes in which she blamed the duo for driving her daughter to take such an extreme step.

Defending Kanda, his lawyer argued that there was nothing in the two documents being relied upon the prosecution - Sharma’s suicide note and FIR lodged by her mother.
