Talwars' allowed only 7 witnesses

The special CBI court on Tuesday allowed only seven of the 13 names that Rajesh Talwar and Nupur Talwar, accused in the Aarushi-Hemraj double-murder case, wanted to produce in court as defence witnesses.

The Central Bureau of Investigation (CBI) had earlier opposed all the names.

Among the witness who have been allowed to testify are RK Sharma, former head of department from All India Institute of Medical Sciences, Dr Urmil Sharma, a gynaecologist, Dr Amulya Chaddha, a doctor, Rajinder Koul and Masuma Jha, who visited the scene of crime on the morning after Aarushi's murder, Vikas Sethi and Mahendra Sharma, a carpenter.

The names of Arun Kumar, former CBI joint director, Dr Richa Saxena, the doctor who examined Aarushi's vaginal slides, Dr SL Vaya, who conducted scientific tests on the accused, the registrar of the Supreme Court of India and two nodal officers of private cellular companies were rejected by the court.

The court ordered the CBI to produce golf sticks during RK Sharma's testimony and rejected the Talwars' request for the examination of the original post-mortem reports of the two victims.

The court also said no further summons would be issued if the addresses of the witnesses were not found.

Dismissing Arun Kumar's name as a witness, the court cited a Supreme Court ruling that said "It is also clear that the final step in the investigation viz. the formation of the opinion as to whether or not there is a case to place the accused on trial is to be that of the officer in-charge of the police-station. There is no provision permitting delegation thereof but only a provision entitling superior officer to supervise or participate..."

The court also dismissed Talwars' plea to place on record scientific test reports related to three previous suspects — Raj Kumar, Krishna and Vijay Mandal. The next hearing is scheduled for June 20.

Aarushi was found brutally murdered in the Talwars' Noida residence on May 16, 2008.  The body of their domestic help Hemraj was found the next day from the terrace of the house.
