Banda police asked to lodge FIR

THE ALLAHABAD High Court on Tuesday directed the Banda police to register an FIR in connection with the brutal beating and killing of an undertrial in the Banda jail.

THE ALLAHABAD High Court on Tuesday directed the Banda police to register an FIR in connection with the brutal beating and killing of an undertrial in the Banda jail.

The court passed the order on a writ petition filed in connection with the incident. Besides, the court directed the Banda superintendent of police to get the incident probed by an officer of not below the rank of deputy superintendent of police.

Passing these directives, a division bench comprising Justice RC Deepak and Justice VD Chaturvedi issued notice to principal secretary (home), Uttar Pradesh, Lucknow, superintendent and jailer of the Banda district jail to file replies within four weeks. The court directed to list this case on November 8.

Earlier, during the hearing, counsel for the petitioner KK Roy assisted by Prem Prakash Singh, said that Munna Shah, a resident of Katra Takia, police station of Banda was arrested by the police in connection with drug trafficking.

He was lodged inside the jail where he was beaten up by the police. He was brought to a hospital where he was declared brought dead.

The father of the deceased sent an application to Banda superintendent of police and jail superintendent for getting a report lodged in this regard but nothing happened.

Thus, Aneesa, wife of the deceased Munnu Shah filed a writ petition.

While passing the order, the court observed: “We have perused the application and the post-mortem examination report of the deceased. The post-mortem examination report indicates the presence of injuries on the person of the deceased and he appears to have died of the same.’’
