The BJP on Thursday said the reported move by the J&K government to nominate 8 persons to the legislative council was a violation of the model code of conduct and asked the Election Commission to take cognizance of the matter.

In a letter written to the Chief Election Commissioner (CEC), BJP legislative party leader, Prof Chaman Lal Gupta asked the CEC to look into the matter personally and ensure that the proposal is not implemented while the model code of conduct is in force in the state.

"It has been reported in the press that a proposal has been sent to the state governor by the National Conference- Congress ruling coalition government to nominate eight persons as MLCs," the letter said.

Some of the persons whose names have been sent are defeated candidates of the NC and Congress in the just held assembly elections, the letter said.

"No ruling party can fill any seat of MLC or nominate any person for the seats of the upper house when the model code of conduct (MCC) is in force," Gupta said.

"Hence, you are requested to kindly look into this matter personally and ensure that this proposal is not implemented till the MCC is in force in the state," the letter said.
