CBI custody for Amin and Rathod accused in fake encounter case

Two policemen accused in the Sohrabuddin Shiekh fake encounter case of 2005 have been sent to CBI custody for four days by a local court here today.

CBI had sought 14 days custody of N K Amin and V A Rathod, arrested by the previous investigation agency state CID crime, for further questioning in the Sohrabuddin fake encounter case.

The duo had opposed CBI's plea saying that it was unwarranted as they have already been questioned in this regard.

CBI court judge V B Barot after hearing arguments of both the parties, sent Amin and Rathod to CBI custody from May 20 to May 24.

Amin and Rathod, filed an application seeking stay on the court order to challenge it in the Gujarat High Court.

The duo had contended that the order was a unique one where remand is given three years after the accused were arrested and that too to an investigating agency, which had not made the arrest.

The application was however, rejected by Judge Barot.

Amin was assistant commissioner of police (ACP) city crime branch before being arrested based on statement of a witness involved in the operation of abducting Sohrabuddin and his wife Kausar Bi. While Rathod, a police inspector, is alleged of being involved in disposing of the body of Kausar.
