Contempt notice to Army Chief

A SINGLE bench of the MP High Court comprising Justice R K Gupta has served show-cause notices on Chief of Army Staff General J J Singh and Principal Controller of Defence Accounts (pension), asking why contempt proceedings should not be launched against them, while hearing a petition of a blind retired Sepoy.

A SINGLE bench of the MP High Court comprising Justice R K Gupta has served show-cause notices on Chief of Army Staff General J J Singh and Principal Controller of Defence Accounts (pension), asking why contempt proceedings should not be launched against them, while hearing a petition of a blind retired Sepoy.

The petitioner’s counsel, R B Singh, contended the despite the HC order of January 5, Sant Kumar, a resident of Imali village of Sihora tehsil of Jabalpur district, hasn’t received his pension benefit.

Singh told the court his client joined the defence force as gunner on January 8, 1971, but was boarded out from the Army in 1980 after he turned blind following a series of operation in the Army Hospital. Since then, Kumar hasn’t received any pension benefit and is living in penury.

Singh told court that even though court has ordered Army to clear his pension benefit with 10 pc interest in three months, its directive hasn’t been acted upon yet. The counsel told the court that the copies of the order were sent to General Singh and authorities concerned on January 13, which were received by them on January 17.
