Kerala High Court today observed that the decision of the selection committee to grant moderation marks in the written examination conducted for the selection of District and sessions judge was 'unsustainable'.
The observation in this regard was made by a division bench comprising chief justice J Chelemeswar and justice P R Ramachandra Menon on a petition filed by Minu mathew and Jayachandran challenging the moderation granted to certain candidates.
The bench held that the seven candidates who were found eligible initially on the baiss of their securing the cut off marks should attend the viva voce and appropriate decision should be taken by the selection committee.
According to the petitioners, only 4 candidates had the prescribed minimum marks and others who had failed to get the minimum marks got selected on the basis of the moderation marks. Of the six selected, four have already been appointed as district and sessions judge.
