Developer told to pay Rs 1 lakh compensation

The District Consumer Disputes Redressal Forum has ordered a private developer to pay compensation of Rs 1 lakh to a person, who booked a flat in 2005 but never received possession. It also directed the company to pay 18% interest on the booking amount of Rs 1 lakh to the complainant, a resident of Sector 46, Gurgaon.

Dr Suman Bishnoi had applied for a flat at Chauma village in Gurgaon. The opposite party advertised about the project to be developed in the village. She had deposited a sum of Rs 1,00,000 in 2005. Bishnoi alleged that the developer's act of not providing her the property had caused great mental agony to her.

The forum realised the complainant had deposited Rs 1,00,000 on March 30, 2005 for an immovable property with preference of village Chauma. The developer was directed to deliver the possession of the flat according to the preference of the complainant in Chauma or in adjoining areas.

The forum said she was entitled to interest on the amount of Rs 1,00,000 that she deposited since March, 2005 at the interest of 18% per annum till delivery of possession of the property.
