Dying declaration?

HOW CONCERNED had been police in the Mehar case probe could be gauged from the fact that they didn’t even record her dying declaration (DD).

None of the senior cops ever enquired Hazratganj police if they had made any efforts to get the DD recorded while the victim was undergoing treatment for 25 days.

Inspector general of police (IG) OP Tripathi questioned concerned cops about the DD only after Mehar’s death.

The cops reportedly replied to the IG that an additional SP rank official had once asked Mehar’s kin whether she could give the declaration when she was in a Delhi hospital. They were told that she was unconscious. But, none of the cops ever visited Delhi in this regard. 

As per the procedure, the cops must intimate the magistrate about recording the DD in the attempt to murder cases. The victim speaks about the motive and identity of the assailant in his declaration and hence it happens to be vital evidence in nailing the accused in court trial.

Mehar’s daughter-in-law Kavita and her daughter Farah both said she (the victim) had told them that it was Amit Singh who had shot at her. The victim stayed in the city for medical treatment for 24 hours before being shifted to Delhi. But, the cops did not take any initiative for DD. Mehar’s statement was sufficient enough to ascertain the role of the accused in the crime.

The police named Sachin Pahadi as the assailant and Amit Singh as co-accused following revelation made by Pramod who was arrested in the case earlier.

Meanwhile, the police have yet to collect details about Amit Singh even though they quizzed latter’s father in Mughalsarai on Tuesday. The cops have yet to corroborate involvement of Amit Singh of Mughalsarai, as the complainant (Mehar’s driver) reportedly did not confirm the identity after the photograph was shown.

The police have yet to confirm if it was the same Amit Singh who was accompanying Sachin Pahadi when the shootout had taken place on February 28. Now, the cops were trying to arrange the recent photograph to corroborate the same.

On the other hand, the police teams sent to Mumbai and Pithauragarh to trace Sachin returned with no vital details.
