Triggering a possible face-off between the two premier agencies of the country, the CBI has written to the IB seeking its classified reports on Sadik Jamal Mehtar who was killed in a fake encounter by the Gujarat police on the intervening night of 12/13 January, 2003, in Ahmedabad.
The CBI and IB earlier had a bitter feud over questioning of senior IB official Rajinder Kumar in the Ishrat Jahan fake encounter case. Kumar, who retired from service on July 31 this year, was questioned twice by the CBI while he was serving. He is under the scanner in the Sadik Jamal case as well.
“We have sought documents from the IB on Sadik Jamal case,” said a CBI spokesperson.
The CBI wants to know on what basis the IB branded Jamal as a Lashkar-e-Taiba member who had come from Dubai to kill Gujarat CM Narendra Modi and VHP leader Praveen Togadia and also what transpired between the IB offices in Delhi, Mumbai and Ahmedabad before his encounter.
In Dubai, Sadik was staying with gangster Dawood Ibrahim’s associate Tariq Parveen. But he was sent back to India after an altercation with associates of Parveen in October, 2002.
“After Sadik’s return, an input was generated by the Subsidiary Intelligence Bureau (SIB), Mumbai that he was a D-gang member and arrived from Dubai with an intention to kill certain right wing Hindu leaders,” says a CBI report.
Investigators say Sadik was picked up from near Asra hotel in Andheri on December 19, 2002 at the instance of SIB, Mumbai and kept at a Mumbai crime branch office. On January 3, 2003, Tarun A Barot, then an inspector in the Ahmedabad police, picked Sadik from Mumbai and illegally confined him at the Dafnala, Shahibagh office of the Ahmedabad crime branch till his killing.
The CBI has questioned more than six serving and retired officials of the IB in the case.
