Formulate new policy on stirs : HC

The Lucknow bench of the Allahabad high court on Wednesday asked the state government to formulate a new policy for agitations and demonstrations by the people within two months.

Passing its interim order, the division bench of chief justice SK Singh and justice SN Shukla said the policy should protect the fundamental rights of the common man and those holding the demonstrations.

After two months, the case will come up for hearing before the court.

The order was issued on a petition filed by former judicial officer and Naitik Party president CB Pandey who had challenged the 2011 guidelines of the Mayawati government about holding agitations and demonstrations in the state. The petitioner had termed the guidelines unconstitutional and against the fundamental rights of the people.

While issuing the guidelines in April 2011, the Mayawati government had put in place stringent curbs on those organising the agitations.

Even as district magistrate’s permission was made compulsory, the government had also placed certain other restrictions on the people.

The government order, which had then invited strong criticism from the opposition, said the organisers would have to pay for any loss to public property during the demonstrations.

Referring to Supreme Court guidelines of 2009, the Mayawati government, which was facing massive anti-incumbency in 2011 just a year before the assembly election, issued the order imposing severe restrictions on holding rallies, processions, dharnas and public functions.

The Naitik Party had moved the high court challenging the order. The court on Wednesday issued its interim order on the plea.
