Gujarat riots: SC to pass order on Jafri murder case on Monday

The Supreme Court on Monday would pass its order on the probe into the killing of Congress MP Ehsan Jafri in Ahmedabad during 2002 riots in which the role of Gujarat Chief Minister Narendra Modi has come under the scanner.

A special bench comprising justices DK Jain, P Sathasivam and Aftab Alam will pass the direction on the basis of a confidential report submitted by amicus curaie on the investigation carried out by SIT which had reportedly given clean a chit to Modi.

The report, which was filed in a sealed envelope, analyses the investigation and evidence recorded by the SIT.

The report was prepared and submitted by senior advocate Raju Ramachandran who is assisting the bench as an amicus curaie in nine riot cases on the direction of the apex court which had on May 5 sought an "independent overview" of the evidence recorded by the Special Investigation Team (SIT).

The apex court had asked Ramachandran to analyse the report, take comments and statements of the witnesses and, if needed, interact with them to give an "objective" assessment of the evidence.

The senior advocate prepared the report after visiting Ahmedabad and talking to many people including witnesses and police officers.

The bench had, on the last date of hearing on July 28, said it would pass the order on the basis of the report.

"It is an elaborate report. The amicus curaie has tried to cover all aspects. We have read it. We will pass certain directions," the bench had said.

"We will pass order and indicate the future course of action," it had said.

The bench had also turned down the plea of the state government seeking a copy of the report and said it would be given only at the appropriate stage.

The apex court will also examine the affidavit filed by Gujarat IPS officer Sanjeev Bhatt who had claimed that he had attended the February 27, 2002, meeting called by Modi.

The bench had said Bhatt's affidavit would be considered only after it gets an independent analysis of the report of the SIT by Ramachandran.

The SIT in its status report has considered the statement of the IPS officer.

Bhatt, a 1988-batch IPS officer who was posted as DCP at the State Intelligence Bureau (SIB) during the riots, had filed an affidavit on April 14 alleging Modi had instructed the officers during a meeting on February 27, 2002, to allow Hindus 'to vent their anger' during the clashes and he wanted Muslims to be "taught a lesson".

SIT has, in its status report, also mentioned about a letter written by suspended Gujarat IAS official Pradeep Sharma requesting to be allowed to depose on information received from the CM's office during the period.
