HC bench recuses itself from hearing Lavasa petition

A division bench of the Bombay High Court, presided over by Chief Justice Mohit Shah, on Monday recused from hearing the petition filed by Lavasa Corporation challenging the show cause notice and the stop work order issued by the ministry of environment and forest.

A division bench of the Bombay High Court, presided over by Chief Justice Mohit Shah, on Monday recused from hearing the petition filed by Lavasa Corporation challenging the show cause notice and the stop work order issued by the ministry of environment and forest.

As soon as the petition was called out for hearing on Monday, Chief Justice Shah declared that he would not be in a position to continue to hear the matter saying one of his close relatives works with the merchant banker, which is handling proposed initial public offer of the parent company of Lavasa Corporation, Hindustan Construction Company (HCC).

The chief justice said the petition will be listed for hearing on Tuesday before some other bench. MoEF had on November 25 issued the notice and the directive to maintain status quo to Lavasa saying the company had failed to obtain requisite environmental clearance before going ahead with its hill station project.
