Retired Commander Jarnail Singh Kalra, arrested in June 2006 for allegedly passing on classified information to other accused in the Naval War Room Leak case, was on Friday denied bail by the Delhi High Court.
Justice Sunil Gaur dismissed a bail petition filed by Kalra seeking released on bail in the case as another accused, Abhishek Verma, a Delhi-based businessman and the son of former MP Veena and poet Srikant Verma, was granted bail by the Court in May this year.
"I am of the view that at this stage it would be premature to say that there is no evidence against the petitioner. Whether the offence of the criminal conspiracy is made out or not would be seen by the trial court at the stage of hearing on point of charge," the court said in an order.
According to an FIR under the Official Secrets Act, on inquiry it was found that the prime accused Kulbhushan Parashar and Ravi Shankaran (still absconding) and Abhishek Verma in association with Naval officers in the Defence Ministry, including Kalra and Capt S S Rathor, had hatched a conspiracy to leak classified informations.
It was alleged that Rathor had unauthorisedly obtained the classified documents from Kalra, working as the Deputy General Manager, Customer Service, Hindustan Aeronautics Ltd (HAL).
They had used advanced communication technology including pen drive, scanners, fax machine and e-mails etc.
