HC notice to Fauji for his 'involvement' in murder case

The petition filed by Subhash Chander of Bhiwani and an injured witness came up for hearing on Thursday before the court headed by justice Inderjit Singh that issued notice of motion for November 13.

The case relates to an FIR registered on March 21, 2012, under Sections 302 (murder), 392 (robbery), 394 (voluntarily causing hurt in committing robbery), 397 (robbery or dacoity, with attempt to cause death or grievous hurt) of Indian Penal Code (IPC) and Section 25 of Arms Act at Bhiwani.

The petitioners have sought directions for staying the trial court proceedings in the FIR in Bhiwani. Chander had alleged the involvement of Fauji in a murderous assault in which his cousin, Rajbir, was murdered, while he and Vinod Yadav were injured.

Appearing for the petitioner, advocate Naresh Singh Shekhawat submitted that when the investigation was in progress and people were insisting that Fauji's role in the case should be investigated, the CPS consumed a poisonous substance at his home in Panchkula in April last year and was hospitalised at PGIMER, Chandigarh.

It was submitted that the local panchayat was protesting and "in fact Anita, wife of Vinod Yadav, was having very close relationship with Ram Kishan Fauji". The panchayat and other respectables had then appeared before the superintendent of police and requested him to investigate into the role of Vinod Yadav's wife and Fauji as the attack was made on Vinod Yadav at the instance of Fauji.

The court was informed that the Haryana Police were not conducting a fair investigation into the case, wherein three local Bhiwani criminals - Sunil, Krishan and Rajesh - were implicated. It was alleged that the police had made efforts to terrorise witnesses and the petitioner to remain silent over the matter.
