HC rejects CBI probe into pension scam

SPECIAL JUDGE at district court S S Raghuvanshi has asked Congress leader K K Mishra to obtain permission of State Government for prosecution of public servants in social security pension case.

Mishra had filed a petition last May seeking penal action against former Mayor and State Public Works Department Minister Kailash Vijayvargiya along with former municipal commissioners Nitesh Vyas and Sanjay Shukla among others.

The judge in his order asked the petitioner to obtain prosecution permission from the competent authority under Section 19 of Prevention of Corruption Act 1988 and Section 197 of CrPC for demanding action against public servants that include government employees and elected representatives. The judge said that the petition could not be continued further without such permission.

Meanwhile, Madhya Pradesh High Court division bench at Jabalpur has dismissed the public interest litigation of Mishra in which he had demanded inquiry by an independent agency like CBI into the social security pension scam.
