Former Haryana DGP SPS Rathore, undergoing 18 months’ imprisonment for molesting Ruchika Girhotra, will have to stay in jail till at least June 29.
The Punjab and Haryana High Court has declined to grant him any immediate relief.
The vacation bench of Justice Ajay Tewari on Friday refused bail to Rathore and adjourned the hearing on the plea of suspension of sentence till June 29, putting an end to Rathore’s hopes of early release.
Bail is usually granted when a sentence is up to three years. But, referring to Rathore’s case, Justice Tewari observed: “The accused had been found guilty of particularly odious offence... this rule can be departed from… however, in order to safeguard the right of the accused, hearing of the main case must be expedited.”
Reading out the 15-page judgment, he said, “The application of suspension of sentence is adjourned to June 29, 2010, so that in case main (revision) petition is not heard due to any circumstances beyond control of the applicant then the present prayer be pressed.”
Ruchika had committed suicide in December 1993, unable to bear the trauma that followed the molestation.
