HC to hear Binayak Sen's bail plea today

The Chhattisgarh high court on Wednesday reserved its order on the bail plea of rights activist Binayak Sen to Thursday even as the state government opposed it on the grounds of his links with the Maoists.

"The presumption that he is innocent is unfounded as his association with the Maoists have been proved through evidences beyond doubt," said prosecution lawyer Kishore Bahaduri, strongly opposing Sen's petition.

The prosecution also asserted that Sen's links with the Maoists were clearly established by the fact that the rebels had observed a bandh when he was convicted. The court rejected the assertion saying the statement was extraneous and not related to the case.

Sen is currently lodged in a jail in Raipur after a trial court sentenced him to life term on December 24 on sedition charges over his links with Maoist ideologue Narayan Sanyal. Sanyal and Kolkata-based businessman Piyush Guha were also sentenced to life imprisonment.

Sen's counsels, including eminent lawyer Ram Jethmalani, challenged the conviction of the civil rights activist by the trial court last month.

Jethmalani had argued there was not a single document that could link Sen to sedition.

"The court has not announced a date, but we expect it to pronounce its judgment within the next few days," said Mahendra Dubey, Sen's lawyer.

Activists of People's Union for Civil Liberties and some members of a European Union delegation were also present in the court.
