A woman hailing from Hamirpur district of Himachal Pradesh has accused a former BJP MLA from her home district of raping her at his residence in the Vidhan Sabha Complex in Shimla in March 2012.
The woman alleged that she had earlier approached the Director General of Police and the chief minister's Office (CMO), but no action was taken.
After a fresh complaint was filed with the CMO, it was sent to the Hamirpur Superintendent of Police (SP). But as the alleged incident took place in Shimla, the complaint has been referred to the Shimla SP.
Shimla SP Abhishek Dullar confirmed receiving the report from Hamirpur but said no formal FIR has been registered yet.
"The case is two years' old and facts have to be verified before filing an FIR and we have asked the victim to come to Shimla in a day or two to assist the investigations," Dullar said.
The accused was a sitting BJP MLA when the alleged rape took place.
Reacting to the charges against a former party MLA, BJP's state unit spokesman Ganesh Dutt said, "We welcome any independent probe into the matter but the timing of the complaint suggests that the charges are politically motivated."
"Why did the victim not lodged the complaint immediately after the alleged incident?" Dutt asked and added, "in case the DGP or the CMO did not act she could have approached other authorities like the Assembly Speaker and court".
